2022 offers some legal challenges in the relationship between gym operators and members. Fitness studios will have to implement some legal changes from the legislator. This concerns contract terms, notice periods, the duration of a gym contract and memberships taken out online.
Notice period no longer than one month
Shorter notice periods will apply to contracts concluded with the gym from March 01, 2022. This may not be longer than one month for both the initial term and the indefinite renewal of the contract.
Cancellation button for online memberships
More and more fitness studios are offering the option of signing up for a membership online. Now the legislator has decided that the termination of an online contract should be simplified. From July 01, providers of online contracts must integrate a cancellation button on their website.
Minimum wage to increase in July 2022
The statutory minimum wage has been €9.82 since January 01. An increase to €10.45 is planned for July 01, 2022. It is expected that the government will launch the targeted €12 minimum wage before the end of 2022.
Contract periods of up to 24 months possible
After much discussion at the beginning of last year about the length of contract terms, a consensus was reached in mid-2021. Contract terms in the gym up to a maximum of 24 months are still possible. What has changed, however, is that contracts may no longer automatically renew for a certain minimum period. Although automatic renewal is possible, then only for an unlimited period.
